Terms and Conditions for “Get a Meal, Give a Meal”

1. The code (the “Code”) must be used by the member of First West Credit Union who has received it directly from First West Credit Union (the “Recipient”). The Code is non-transferrable.
2. When the Code is used at a participating restaurant in accordance with these terms and conditions, the Recipient will receive $25 off of an order that is $50 or greater (excluding any applicable taxes and the cost of any alcoholic beverage). The Code has no cash value.
3. The Code cannot be used for an order that is less than $50.
4. The Code can only be used at participating restaurants and participating restaurants reserve the right not to accept the Code and apply the applicable discount.
5. The Code must be only used for an order made directly through the participating restaurant’s methods implemented for accepting the Code. The Code cannot be used for an order that does not include food or any orders that are made through a third party’s platform. The participating restaurants will determine how to accept the Code.
6. In order to use the Code, the Recipient must provide the information requested by the participating restaurant. This will include the Recipient’s full name and telephone number and any other information the participating restaurant reasonably determines is necessary in order to process the Code.
7. First West Credit Union is not responsible for issues that may arise in connection with the use or acceptance of the Code.
8. Only one Code can be used per order and the Recipient cannot combine the Code with another member who has also received a Code. The Code may not be used in conjunction with other coupons or discounts.
9. The Code can only be used between June 8th, 2020 and July 31st, 2020 (the “Acceptance Period”), unless First West Credit Union and the participating restaurant agree to extend the Acceptance Period. Acceptance of the Code is also subject to quantity limitations as participating restaurants can only accept a limited number of Codes. Once the maximum number of Codes allocated to each participating restaurant is reached, the participating restaurant will not be able to accept any more Codes and will have no obligation to accept the Code and apply the applicable discount.
10. Any information provided in connection with the use of the Code becomes the property of First West Credit Union and will not be returned. Information on First West Credit Union use of personal information in connection with the use of the Code and other matters is contained in the privacy policy.
11. The use of the Code is subject to all federal, provincial, and other laws applicable in British Columbia. Void where prohibited. First West Credit Union may, where required by law, disclose the Recipient’s information to the government. If any provision of these terms and conditions is found by any court of competent jurisdiction to be unenforceable, all other provisions will remain in full force and effect.
12. First West Credit Union, its subsidiaries and affiliates, and any of their respective directors, officers, employees, agents, or other representatives will not, under any circumstances, be responsible for, or liable to any Recipient or any other person for:
    1. any erroneous, lost, damaged, late, incomplete, misdirected, deleted, defective, or altered Codes, regardless of the cause;
    2. any computer, online, telephone, or technical malfunctions or errors that may occur, regardless of the cause;
    3. the Code is not capable of being used or accepted in accordance with these terms and conditions;
    4. and any damage or loss, including any loss of use, loss of production, loss of profits (anticipated or otherwise), loss of markets, economic loss, special, indirect or consequential loss or damage or punitive damages, whether in contract, tort or under any other theory of law or equity, arising from, connected with, or relating to the use of the Code or the use of any First West Credit Union website (including the downloading of any materials from that web site) or use of any participating restaurant’s website and regardless of the cause or any negligence by First West Credit Union or anyone for whom First West Credit Union is responsible, and notwithstanding that First West Credit Union may have been advised of the possibility of such loss or damage being incurred.
13. None of First West Credit Union, or any other subsidiary companies of First West Credit Union, or any of their respective directors, officers, employees, agents, or other representatives will be responsible for injuries, accidents, loss or misfortune relating to the Code or its use or failure to use the Code. The Recipient agrees to indemnify and save harmless First West Credit Union, or any other subsidiary companies of First West Credit Union and each of their respective directors, officers, employees, agents and other representatives (and each of them) of and from all claims, demands, proceedings, liabilities and costs whatsoever relating to the Code, a Recipient’s use of the Code or failure to use the Code, including without limitation legal costs on a solicitor-and-client basis. Without limiting anything else contained in these terms and conditions, First West Credit Union and its affiliated companies, and their respective directors, officers, employees, agents, and other representatives are not liable if for any reason this the program for which the Code is intended to be used is not capable of being completed in accordance with these terms and conditions, including without limitation for reasons relating to technical failures, the loss or non-existence of communications capability, computer virus or tampering, or any other cause.
14. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR INTERFERE WITH THE LEGITIMATE OPERATION OF THE USE OF THE CODE OR THE PROGRAM IN CONNECTION WITH WHICH THE CODE IS PROVIDED TO THE RECIPIENT MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND FIRST WEST CREDIT UNION RESERVES THE RIGHT TO SEEK DAMAGES AND/OR OTHER RELIEF FROM ALL RESPONSIBLE PERSONS TO THE FULLEST EXTENT PERMITTED BY LAW.
15. By attempting to use the Code, you acknowledge that you have read, understood and agreed to be bound by these terms and conditions.
